MY DOG SPOTS TERMS OF USE

Welcome to My Dog Spots and thank you for your interest in our plan to make dog’s lives better. By accessing and utilizing My Dog Spots you agree to the following terms and conditions. These terms and conditions are effective July 1, 2009.

Using My Dog Spots. You will use My Dog Spots in the manner intended without doing any of the following:

  • Violate any laws;
  • Be false or misleading;
  • Copy, modify, or distribute any other person’s content;
  • Bypass measures used to prevent or restrict access to My Dog Spots;
  • Infringe any third-party rights;

Abusing My Dog Spots

Should you determine that anyone is using My Dog Spots in a way not laid out in these terms you can send an e-mail to My Dog Spots. If My Dog Spots concludes that a party is using My Dog Spots in terms not intended we shall eliminate the cause of misuse. In the event that My Dog Spots does remove any content deemed inappropriate we will not accept any liability for monitoring My Dog Spots or for unauthorized or unlawful content on My Dog Spots or use of My Dog Spots by users.

Fees and Services

My Dog Spots does charge fees for advertising on our website. Our fees are listed in Canadian Dollars and can be reviewed at the time you sign up your business. Our fees may change from time to time and any changes made will be listed on our site in the terms of use. We reserve the right to change our fees for special events and promotions. Our fees are non-refundable and must be paid when due. If you neglect to pay our fees we will limit the use of your services on our site. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms (for accounts over 180 days past due, we may deduct the amount owed from your PayPal account balance).

Content

My Dog Spots uses content from you, other users and My Dog Spots. You agree not to copy, modify, or distribute My Dog Spots, our copyrights or trademarks. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights to host and display your content.) If you believe your rights have been violated please e-mail us and we will review your case. If we deem that a party’s rights have been violated we reserve the right to remove that content at our discretion.

Liability

You agree not to hold us responsible for any things other users post or do. We do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered. We also cannot guarantee continuous or secure access to our services. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of My Dog Spots, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) 100 Canadian Dollars.

Personal Information

By using My Dog Spots, you agree to the collection, transfer, storage and use of your personal information by My Dog Spots on servers located in the United States as further described in our privacy policy.

General

These terms and the other policies posted on My Dog Spots constitute the entire agreement between My Dog Spots and you, superseding any prior agreements. This agreement is governed by the laws of Canada. If a court strikes down any of these terms, the remaining terms will survive.
